An Ikeja High Court  yesterday sentenced 27-year-old Oluwaseun Oladapo, to death by hanging for murdering  a Lagos based human rights lawyer, Mr Kunle Fadipe and his mother-in-law, Mrs Cecilia Owolabi.

In her judgement,  justice Oluwatoyin Ipaye found Oladapo guilty on a five-count charge of murder, armed robbery and assault occasioning harm pressed against him by the state.

Handing down her sentence, Justice said:  “On count one, you Oluwaseun Oladapo, is to be hung by the neck till you are dead.

“On count three, you Oluwaseun Oladapo, is to be hung by the neck till you are dead.

“On count four, you Oluwaseun Oladapo is sentenced to three years in prison.

“On count five, you Oluwaseun Oladapo is sentenced to three years in prison.

“The terms of imprisonment of counts three, four and five is that they should run concurrently. This is the judgment of the court.”

Earlier before the sentence was passed, counsel to the convict, Mr Worer Obuagbaka pleaded for mercy on behalf of the convict.

“I ask this honourable court to give him a second chance, he is a young man who is still useful to society, I urge this honourable court to please temper justice with mercy,” Obuagbaka said.

Responding, prosecuting counsel, Mrs O.A Olugasa said:  “The deceased was not given a second chance, his children were not given a second chance to have their father with them.

“I urge the court to give the harshest punishment to the convict so that justice can be seen to be done.”

Oladapo, allegedly murdered the lawyer at 3am on July 4, 2014 at his residence located at No. 1 Harmony Estate, Ifako-Ijaiye, Iju, Lagos.

The prosecution was led by Mr Adeniji Kazeem, the Lagos State Attorney General and Commissioner for Justice and  Mrs Idowu Alakija, the Director of Public Prosecution (DPP).

Oladapo, was also charged with the murder of Mrs Cecelia Owolabi,  the mother-in-law to the late Fadipe, but the charge of murder was commuted to assault occasioning harm by the court.

Explaining the reason for why the murder charge of Owolabi was rejected, Justice Ipaye said: “The prosecution did not prove a direct link between the actions of the defendant and the death of Madam Cecelia Owolabi.

“He is however, found guilty of the assault occasioning harm of Madam Cecelia Owolabi.”

During the trial, the wife of the late lawyer, Mrs Kemi Fadipe, in her testimony gave a graphic details of how the lawyer was murdered.

Kemi, a school proprietress said: “My husband came in late from the office at 10pm and he was preparing for a flight to Abuja the following day, we both had retired to our bedroom.

“Our home is a five – bedroom duplex and there was no electricity that night, the home was well lit because the generator was on.

“At 11.45pm, power was restored and my son Folahanmi went to put off the generator, a few minutes after he left, he came running upstairs screaming for help.

“He had a stab wound on his head and was being pursued by the defendant who was armed with a knife.

“The commotion alerted  my husband and I   rushed to the anti-room upstairs where we saw the defendant and Folahanmi.

“The defendant was saying that someone had to die today and demanded N500,000, threatening us that members of his gang had surrounded the house.

“We knelt down to plead with him and my husband instructed me to get a white envelope containing cash from the jacket of his suit.

“When the envelope was handed over to the defendant, he was dissatisfied and demanded for laptops and phones and we told him those items were downstairs.

“He for no reason, lunged at Folahanmi with a knife and my husband stepped in to save him and he was stabbed in his neck and his chest.”

Why Judiciary should be autonomous, says Sokoto JUSUN

THE Sokoto State chapter of the Judiciary Staff Union of Nigeria (JUSUN) has observed that it is important for the judiciary in the state to be autonomous for it to be efficient and effective in the discharge of its constitutional mandate. In an exclusive interview with Saturday Vanguard, Chairman of the chapter, Abdulnasir Muhammad also called on Sokoto state government to fulfill its promise to fully give financial autonomy to the judiciary arm of government as pronounced in October last year, lamenting that since the announcement of the grant by the Commissioner for Justice, Barrister Suleiman Usman in October 2016, the judicial arm of government in the state was yet to enjoy same.

He observed that with the governor being a lawyer, there was no reason for the arm in the state to remain without autonomy. “The judiciary in Sokoto state, like in other states of the federation, needs financial autonomy in order to operate more effectively and efficiently. The state government convincingly told the people of the state that autonomy had been granted the judiciary but till date, nothing of sort is there. It is our belief that with our dear Governor being a lawyer, the state he governs should be one of those frontline states that should have autonomous judiciary,” he said.

It could be recalled that Barrister Usman had, during a ministerial press briefing at the NUJ Press Centre last year, stated that the governor had approved the payment of budgetary allocations that consisted of salaries, overheads and capital votes meant for the judiciary. “In order to ensure compliance with the constitutional provisions contained in sections 81(3), 121(3), 121(9), and 162(9) of the Constitution of the Federal Republic of Nigeria, 1999 as amended, the governor of Sokoto state, Rt. Hon. Aminu Waziri Tambuwal has graciously approved the payment of budgetary allocations consisting of salaries, overheads and capital votes meant for the judiciary to the Heads of Courts in the state.

“With this development, the state judiciary is now financially autonomous as budgetary allocations consisting of overhead, personnel cost and capital projects will be paid to the Chief Judge and Grand Khadi,” he had stated.

However, Comrade Muhammad disclosed that “apart from the normal N15 million monthly allocations each to the High Court and Sharia Court of Appeal that have subsisted since the immediate past administration, the state judiciary was yet to enjoy any financial autonomy as proclaimed and in spite of the government’s statement that the judiciary will no longer go cap in hand begging for money when we want to work, has not come to fruition. The judiciary is still working under difficult financial atmosphere.”

JUSUN added that the judiciary in the state were under-staffed with the High Court having a total of 180 staff; the Sharia Court of Appeal, 367 staff and Judicial Service Commission (JSC), 36 staff. “The judiciary needs additional staff as well as enhanced salary for the staff,” he said.

Investigations by Saturday Vanguard reveal that although overhead and costs for capital projects were through the state by the Federal government, the judiciary only enjoys the N15 million each for the High Court and Sharia Court of Appeal.

German secret service spied on Nigeria media, others – report

Germany’s foreign intelligence service BND long spied on journalists of the BBC, The New York Times, Reuters and other media, news weekly Der Spiegel reported Friday.

Media rights group Reporters Without Borders labelled the alleged surveillance “a monstrous attack on press freedom”, voiced fears the eavesdropping was continuing and said it was planning legal action, according to Der Spiegel.

The magazine, which has worked extensively with US fugitive intelligence contractor Edward Snowden and has reported on US and German espionage scandals, cited only documents it had seen.

It reported that the BND had listed at least 50 telephone and fax numbers and email addresses of journalists or newsrooms on its list of “selector” keywords for surveillance since 1999.

A Spiegel journalist told AFP that the list was thought to have covered only part of the BND’s international media targets at the time, and that it was unknown whether surveillance had ceased or was ongoing.

On the list seen by Der Spiegel were several dozen numbers of the British Broadcasting Corporation at its London headquarters and in Afghanistan, as well as of the BBC World Service, it said.

A number used by The New York Times in Afghanistan was also on the list, as were mobile and satellite phone numbers of news agency Reuters in Afghanistan, Pakistan and Nigeria.

The BND declined to comment, Der Spiegel said in an excerpt of an article to be published in full in its weekly edition which hits news stands Saturday.

A BBC spokeswoman said: “We are disappointed to hear these claims.

“The BBC’s mission is to bring accurate news and information to people around the world and our journalists should be able to operate freely and safely, with full protection for their sources.

“We call upon all governments to respect the operation of a free press.”

Reuters and The New York Times did not immediately reply to requests for comment from AFP.

Germany had reacted with outrage when information leaked by former NSA contractor Snowden revealed in 2013 that US agents were carrying out widespread tapping worldwide, including of Chancellor Angela Merkel’s mobile phone.

Merkel, who grew up in communist East Germany where state spying on citizens was rampant, declared repeatedly that “spying among friends is not on” while acknowledging Germany’s reliance on the US in security matters.

But to the great embarrassment of Germany, it later emerged that the BND helped the NSA spy on European targets.

Berlin last June approved new measures, including greater oversight, to rein in the BND following the scandal.

Scores of women took to the streets in Argentina Tuesday in a bare-breasted demonstration of solidarity with women recently confronted by police for going topless on a South Atlantic beach.

The demonstrations in Buenos Aires, in Mar del Plata and Rosario, were prompted by an incident two weeks ago in Necochea, 500 kilometers south of the capital.

Three women in bikini bottoms were ordered by 20 police officers to put on their tops or head out.

Many in Argentina, once one of the world’s wealthiest countries, were stunned.

Now used to struggling with economic woes and corruption, they are increasingly tired of what some see as the authorities’ overreach.

“There is this macho way of thinking that just has to end,” said a protestor named Noelia, 28, who declined to give her family name. “We are the owners of our bodies and we can show our bodies if we like. We are not consumer goods.”

As older men in suits and ties scrambled out of nearby offices during the protest, some stopped to stare. A few laughed or giggled.

“You can’t miss a chance to see a bit of tit, can you?” said one man, aged around 60, to nods from others.

“Get out, man! Get out!” some demonstrators chanted, with slogans painted on their skin in lipstick.

Some of the men took selfies with the demonstrators, perhaps not necessarily in solidarity.

The leftist politician Vilma Ripoll said, “All people want to see tits on television. The real ones bother you.”

Last July, thousands of women took part in topless protests across the country after a woman was kicked out of a public area near the capital for nursing her child, triggering widespread outrage.
